Sulaymaniyah Court of Appeals Presidency Clarifies Scope of Decision Annuling Property Grants

On Wednesday, the Presidency of the Sulaymaniyah Court of Appeals issued a clarifying statement regarding the decision issued by the administrative court related to the annulment of property grants, affirming that the decision has not become final and may not be generalized to other cases.

The presidency said that decision No. (57/K/2026), issued on 21 October 2026, has provoked debate and divergent interpretations in the media, some of which contradict the law or even the text of the decision itself.

The presidency added that the operative part of the decision was limited to annulling an administrative order, and that it has not become final; therefore it does not constitute a binding legal precedent to decide similar cases or to generalize its ruling to other facts before it attains finality.

It clarified that the decision addressed a specific case, and that the annulment concerned only an administrative jurisdiction issue; its operative wording should not be interpreted beyond its legal limits or attributed additional implications.

Regarding the file of property ownership in the city of Sulaymaniyah, the court presidency said that regulation of the matter is subject to the constitution and relevant laws, foremost among them the Real Estate Registration Law, and that there is no legal obstacle to citizens from other regions legally owning apartments or properties in Sulaymaniyah.

The presidency warned against interpreting non-final judicial rulings based on personal reasoning, affirming that no party has the right to interpret the judicial decision according to its own view or to generalize a specific case to others that differ in their circumstances and legal particulars.

The Sulaymaniyah Court of Appeals presidency concluded its clarification by stressing the need to treat decision No. (57/K/2026) within the terms of its operative wording and legal content, and not to assign interpretations that exceed the scope of the case it addressed.
